Who operates KeepMPosted
KeepMPosted is operated by Guilherme Perotta, an individual carrying on business as KeepMPosted, and is not a separate incorporated entity. Our legal business and mailing address is 225 Railway Street E., Cochrane, AB T4C 2C3, Canada. In these terms, “we,” “us,” and “our” refer to Guilherme Perotta operating as KeepMPosted. Eligibility and accounts
You must be at least 18 and able to enter a binding agreement. If you use KeepMPosted for an organization, you represent that you have authority to bind it. Keep account details accurate, protect access credentials, and notify us promptly of suspected unauthorized use.
The service
KeepMPosted lets organizations collect confirmed subscribers and send direct updates through supported providers. Features, limits, and delivery channels may change. SMS is not currently available. Provider acceptance does not guarantee that a recipient will read a message or that every network will deliver it to an inbox or device.
Your subscribers and messages
You are responsible for:
- having a lawful basis and any required consent before messaging a person;
- using the provided confirmation and unsubscribe mechanisms and honoring opt-out requests;
- accurate sender details, subject lines, business identity, and a valid physical postal address;
- your message content, offers, customer relationship, and compliance with laws that apply to your organization and recipients.
Do not upload purchased, scraped, harvested, or third-party lists, and do not attempt to bypass consent or suppression records.
Acceptable use
You may not use KeepMPosted for unlawful, deceptive, abusive, discriminatory, infringing, harassing, or harmful activity; malware or credential theft; unsolicited bulk messaging; regulated goods or services where messaging is prohibited; or content that violates a provider's rules. You may not probe, overload, reverse engineer, or evade service security or limits except where law expressly permits.
Credits, payment, and refunds
Credits are prepaid units used for recipient deliveries. The current cost is shown before a message is queued. Credits are reserved while delivery is pending and charged only when a provider confirms successful acceptance. Failed deliveries are not charged. Purchased credits do not expire while the service and account remain available.
Prices and taxes are shown at checkout. Except where required by law or where a duplicate or erroneous charge occurred, credit purchases are final. Contact support@keepmposted.com within 30 days if you believe a billing error occurred. Chargebacks do not replace this support process and may result in suspension while a payment dispute is reviewed.
Third-party services
Authentication, payments, email, Telegram, and infrastructure rely on third-party services. Their terms and availability may affect KeepMPosted. You authorize us to send the minimum necessary data to those providers to operate requested features.
Ownership
You retain ownership of content and business data you submit and grant KeepMPosted a limited license to host, process, transmit, and back up that content only as needed to operate, secure, and support the service. KeepMPosted and its licensors retain rights in the platform, brand, software, and documentation. Feedback may be used to improve the service without restriction or compensation.
Suspension and termination
You may stop using the service at any time. We may limit or suspend access when reasonably necessary to protect recipients, providers, users, or the platform; investigate suspected violations; comply with law; or address unpaid or disputed charges. We may terminate for a material or repeated violation. Data handling after termination follows the Privacy Policy and applicable legal duties.
Service changes and availability
We work to keep KeepMPosted available but do not promise uninterrupted or error-free operation. Maintenance, provider outages, security events, legal requirements, and events outside reasonable control may interrupt delivery. We may modify or discontinue features and will provide reasonable notice when a material change adversely affects active users where practical.
Disclaimers and liability
To the maximum extent permitted by law, the service is provided "as is" and "as available" without implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Nothing in these terms excludes rights or liability that cannot legally be excluded.
To the maximum extent permitted by law, KeepMPosted is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profit, lost business, or lost data. Our aggregate liability arising from the service will not exceed the amount you paid to KeepMPosted during the 12 months before the event giving rise to the claim.
Changes, disputes, and contact
Applicable law governs these terms without overriding mandatory consumer protections. Before filing a claim, contact us and allow 30 days to try to resolve it informally. A court with lawful jurisdiction may hear unresolved disputes. If one provision is unenforceable, the remaining provisions continue.
We may update these terms and will identify the effective date. Material changes may require renewed acceptance. Questions can be sent to support@keepmposted.com.
